When Psychological Evaluations Can Support Your Immigration Case
Psychological evaluations provide valuable documentation to support immigration cases. They help demonstrate the emotional, psychological, and practical hardships individuals and families face due to trauma, separation, persecution, or victimization. These evaluations are often essential in various immigration cases, including those listed here.
-
A psychological evaluation for asylum documents the mental health impact of persecution, torture, or threats based on factors like political opinion, religion, gender, or ethnicity. It provides clinical insight into symptoms of PTSD, anxiety, and depression to support an asylum claim.
-
A psychological evaluation for an Extreme Hardship Waiver helps demonstrate the emotional, psychological, and practical challenges a U.S. citizen or resident would face if separated from a loved one. It documents the impact of family separation, financial instability, medical concerns, and cultural hardships that may arise.
-
A VAWA psychological evaluation supports individuals applying for legal protection due to abuse by a U.S. citizen or permanent resident spouse, parent, or child. It assesses the emotional and psychological effects of domestic violence, helping to document trauma, distress, and ongoing harm.
-
A T Visa psychological evaluation assesses the psychological effects of human trafficking, including trauma, exploitation, and coercion. It documents symptoms like PTSD, anxiety, and depression, highlighting the lasting impact of abuse and the need for safety and support.
-
Psychological evaluations may also be required for U Visas (victims of crime), Cancellation of Removal (deportation proceedings), Special Immigrant Juvenile Status (SIJS), and Refugee Waivers. These evaluations document mental health conditions, trauma, and hardships that impact a person’s eligibility for immigration relief.
